A Nebraska Food Processing company was fined for falsely representing produce grading records.
On December 9, Nebraska Beef Ltd. was sentenced in federal court in Omaha, Nebraska for false representation relating to agricultural grading records. Nebraska Beef was sentenced to a year of probation, a $200,000 fine, and civil settlement fine of $550,000 as part of a civil settlement with the government for its conduct.
On June 3, 2016, Nebraska Beef received a Grand Jury Subpoena that ordered Nebraska Beef to provide grading records for 30 beef carcasses. A Nebraska Beef Corporate Officer altered the grading records before providing them to representing attorneys of Nebraska Beef, who then delivered the altered records to the Grand Jury. The United States Attorney’s Office was provided the altered grading records June 13, 2016.
On May 6, 2022, a former Nebraska Beef employee, Dolese Tippery, 61, of Council Bluffs, Iowa, was sentenced in federal court in Omaha for false representation relating to agricultural grading records. Tippery was sentenced to 6 months of probation and to pay a $1,000 fine. Tippery admitted in a Plea Agreement that she testified on behalf of Nebraska Beef that Nebraska Beef grading records that were provided to the United States Attorney’s Office were not altered, which was false.
On September 9, 2022, former Chief Financial Officer of Nebraska Beef, James Timmerman, 50, of Omaha, Nebraska, was also sentenced in federal court for false representation relating to agricultural grading records. Timmerman was sentenced to 2 years of probation and to pay a $1,000 fine.
The case was investigated by the U.S. Department of Agriculture-Office of Inspector General and the FBI.
