KEARNEY — The case of a Kearney man charged with first-degree sexual assault and domestic violence has been bound over to district court. A jury trial date has also been set for the spring of 2026.

Jason Gundersen, 43, first-degree sexual assault, a Class 2 felony; assault by strangulation or suffocation, a Class 3A felony; first-degree false imprisonment, a Class 3A felony; third-degree domestic assault – cause bodily injury, a Class 3A felony, resisting arrest – first offense, a Class 1 misdemeanor, obstruct a peace officer, a Class 1 misdemeanor and criminal mischief – $500-1,499, a Class 2 misdemeanor.

Gunderson’s case had been bound over to Buffalo County District Court after a preliminary hearing was held in November.

On Dec. 5, Gunderson appeared for arraignment and pleaded not guilty to the charges. A status hearing in the case was set for Jan. 20, 2026, at 10 a.m.

A final pre-trial hearing was set for March 10, 2026, at 10 a.m. and a jury trial was scheduled to begin on April 13, 2026, at 9 a.m.

The affidavit for the support of continued detention has been sealed in this case, but the complaint filed in the court record alleges that Gundersen subjected his intimate partner to sexual penetration without their consent on Sept. 4 at a location on Highway 30 in Kearney.

Gundersen is also alleged to have impeded the breathing of the person, restrained them and caused bodily injury. This would be Gundersen’s second domestic violence offense, having been convicted of the charge on Sept. 18, 2023, according to the complaint.

Gundersen was arrested and booked into the Buffalo County Jail on Sept. 4.
